DEFINITIONS

 

Amateur means a person who, whether they play competitively or recreationally, plays golf for the challenge it presents, not as a profession and not for financial gain.

Attendee means any Participant and Non-Competing guest.

Consequential Loss means any loss of profits, loss of revenue, loss of opportunity or consequential or indirect loss.

Eligible Participants means members of Qantas Golf Club who have an official Golf Australia or an approved country handicap

Event means the 2019 Mission Hills Tournament.

Event Committee means a committee made up of representatives of Qantas, GolfNow and the Promoter that will be responsible for establishing and enforcing the terms of the Event.

Golf Course(s) means Black Stone Course, The Vintage Course and Stone Quarry Course golf courses.

GolfNow means GolfNow, LLC, an Arizona limited liability company, located at 7580 Golf Channel Drive, Orlando, FL 32819

Local Rules means the rules of Black Stone Course, The Vintage Course and Stone Quarry Course golf courses.

Member means a person who holds Free or VIP Membership of Qantas Golf Club

Non-Competing Guests means an individual who attends the Event as a guest of a Participant and who is not competing in the golfing aspect of the Event.

Participant means a member of Qantas Golf Club who has entered into and has been accepted by Qantas / GolfNow to participate in the Event. Participants must be members of the Qantas Frequent Flyer program and Qantas Golf Club. A Qantas Frequent Flyer membership number is required as part of the online registration process. A Participant must hold a Golf Australia handicap or an approved country handicap.

Professional means a person who plays competitively as a profession, for financial gain.

Promoter means Qantas/GolfNow or its assignee.

Qantas means Qantas Airways Ltd or any of its related bodies corporate.

Qantas Frequent Flyer Member means a person who is a member of the Qantas Frequent Flyer program. Qantas Frequent Flyer Membership has a corresponding meaning.

Qantas Frequent Flyer Program means the loyalty program currently known as the Qantas Frequent Flyer program.

Qantas Frequent Flyer Terms means the terms and conditions of the Qantas Frequent Flyer Program issued by Qantas, as amended from time to time.

Registering Participant means the Participant that registers the Team into the Event.

Team means the 4 Participants that have been assigned as a team to participate in the Event.

Third Party Products means the ability to acquire goods or services from third parties that are not, or on terms that are not, available to persons that are not Members. The provision of Third-Party Products will be subject to the terms and conditions of the applicable third party suppliers. Qantas/GolfNow/ or its assignee all liability in relation to Third Party Products.

 

GENERAL

 

These Terms and Conditions govern all aspects of the Event, including the website, marketing communications, registration and the Event itself. These Terms and Conditions are effective from the date of publication and may be amended from time to time by Qantas / GolfNow in its sole discretion.

By registering for the Event, each Attendee agrees to be bound by these Terms and Conditions and is responsible for complying with these Terms and Conditions (as amended from time to time).

If any terms in these Terms and Conditions are illegal, invalid or unenforceable then that term will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible, it will be severed from these Terms and Conditions and the remaining provisions will continue to apply.

These Terms and Conditions are governed by and will be construed in accordance with the laws applicable in New South Wales, irrespective of the location of the Event or where the registration for the Event has been completed by an Attendee or submitted to Qantas /GolfNow.

Qantas /GolfNow reserves the right at any time to cancel, modify, suspend or supersede the Event in its absolute discretion if it considers the Event is not capable of being conducted as specified, or if required to do so by law. Qantas / GolfNow reserves the right to refuse entry to the Event if an Attendee does not comply with the Terms and Conditions of the Event.

 

ELIGIBILITY

 

The number of tickets available for the Event is strictly limited and may sell out at any time. Tickets are unable to be reserved for the Event. Bookings will be accepted on a first come, first accepted basis.

Only Qantas Golf Club members can register for the Event.

A Participant of the Event must be 18 years of age or over as at the first day of the Event.

To be eligible to win any of the prizes on offer a participant must meet the Eligible Participant requirements.

Players without an official handicap will play in a separate category and be ineligible to win any major prizes

 

PAYMENT

 

Should you choose to pay for your event booking by the deposit method, the following conditions shall apply:

Initial Deposit until 24th December 2018 – 20% of listed event charge plus any additional accommodation and/or other options you choose at time of booking

Balance – the balance will be due and payable from your nominated credit card on 4th February 2019 and we will notify you 7 days prior to deducting the balance due to ensure that you have funds available for processing. Any fees levied to you by your financial institution will be payable by you and is not the responsibility of either Qantas/GolfNow or the Promoter.

Qantas/GolfNow and the Promoter shall not be liable for any losses incurred by an Attendee as a result of the cancellation of the Event or a change to the date, time or venue of the Event (whether such cancellation or change is caused by the Qantas/GolfNow and/or the Promoter’s own fault, factors beyond the Qantas/GolfNow and/or the Promoter’s reasonable control or otherwise). For this reason, it is strongly recommended that you arrange for an appropriate travel insurance policy.

If redeeming Qantas Points for the Event, a Participant must select ‘Redeem Qantas Points’ on the registration form. When this is selected, the Participant will be contacted by Qantas within 5 business days to process the Qantas Points deduction. A Participant is required to redeem the full amount in Qantas Points, a combination of Qantas Points and any other payment method cannot be used. The redemption of Qantas Points is subject to the Qantas Frequent Flyer Terms and Conditions. A Participant must have the required amount of Qantas Points to redeem for the event at the time of registration and until the points deduction has been made. If a Participant cannot be contacted to redeem Qantas Points within 7 days of registration then Qantas will automatically cancel the booking on behalf of the Participant.

Any refund or cancellation requests must be made in writing to The Promoter at info@qantasgolf.com.au

Cancellation fees apply as follows: 

     If paying by cash:

If a member cancels prior to 24th December 2018, a refund will be given, minus a $300.00 administration fee.

If a member cancels between 24th December 2018 and 4th February 2019 (inclusive), a refund will be given, minus 60% of the total Event Price plus any additions will be forfeited.

If a member cancels after 4th February 2019, a refund will not be given and 100% of the Event Price plus any additions will be forfeited.

Qantas Points will be earned on the amount paid for the Event, minus any refund received as outlined above.

 

TRANSPORT

 

Only airport and golf transfers relating to the Mission Hills Tournament on the ground in China are included in the cost of the event.

Qantas/GolfNow and The Promoter exclude all liability for Consequential Loss.

The Event may include the supply of goods or services from third parties (Third Party Products). The provision of Third-Party Products will be subject to the terms and conditions of the applicable third party suppliers. Qantas/GolfNow excludes all liability in relation to Third Party Products.

Each Attendee is responsible for ensuring that all necessary personal insurance policies (including medical insurance and travel insurance) are obtained prior to the Event.

To the extent permitted by law, each Attendee agrees to release and hold harmless Qantas/GolfNow, the Promoter and each of their employees, agents, sub-contractors, directors, officers and related bodies corporate from any and all actions and claims which may be made by the Attendee or on behalf of the Attendee or by other parties for, or arising out of, any injury, loss, damage or death occurring as a result of participation in the Event.

Qantas/GolfNow shall not reimburse an Attendee for travel expenses incurred as a result of failure to use the airport transfers provided by Qantas/GolfNow (whether such failure is due to their own fault, factors beyond their reasonable control or otherwise).

EVENT RULES

 

Play will be conducted in accordance with the Royal & Ancient Rules of Golf as available at http://www.randa.org/.

The Event Committee will announce any special or additional Local Rules that will apply to the conditions of play for the day.

At registration, all Participants must present to a representative of Qantas/GolfNow their official handicap card certifying their current Golf Australia handicap. Failure to do so may result in disqualification from the tournament.

Eligible Participants must play off their official handicap as at the time of commencing the first round and not the handicap as at the time of entering the Event. The maximum handicap is 27 including the Slope adjustment for males and 36 including the Slope adjustment for Females.

Distance measuring devices such as GPS based systems and laser rangefinders that measure distance only are permitted for use in the Event. However, Participants using any such devices designed to gauge or measure other conditions that might affect a player’s game (for example gradient, wind speed, temperature etc.) are deemed to be in breach of Rule 14-3 of the R&A Rules of Golf (The Rules), the penalty for which is disqualification regardless of whether such devices are actually used.

A draw for the day’s play will be made and displayed. Participants shall start at the time and in the order arranged by the Event Committee. A seeded draw may be conducted (in handicap order) and players must start at the time established by the Event Committee, in accordance with Rule 6-3a (The Rules). Starting times will be made known by the Event Committee following completion of player registrations and announced later that day. Rule 6-3a (The Rules) provides: “The player shall start at the time established by the Event Committee”. The penalty for breach of Rule 6-3a is disqualification. However, it is a condition of the tournament that, in the absence of circumstances which warrant waiving the penalty of disqualification as provided in Rule 33-7 (The Rules), if a player arrives at his starting point, ready to play, within five minutes of his starting time, the penalty for failure to start on time is two strokes at the first hole in stroke play, instead of disqualification.

It will be obligatory for all Participants to play with conforming golf balls and equipment. All conforming balls are listed in the current R&A, and/or USGA approved lists (www.randa.org).

The Event Committee shall have the sole management and control of the tournament, with the full power at any time to alter or vary any conditions. The Event Committee’s decision on any matters affecting the tournament shall be final and the Event Committee shall not be responsible for any disadvantages that may occur as a result of a competitor’s ignorance of the Golf Challenge Guidelines and Regulations. It is the responsibility of each Participant to ensure that they understand the Tournament Guidelines and Regulations.

Pace of Play – To assist in keeping the field moving players are requested that once they have exceeded the number of strokes allocated and thus are unable to score points on any particular hole, that they pick up their ball and move to the next hole.

 

PRIZES

 

Prizes for Participants may be awarded during the Event by Qantas/GolfNow in its absolute discretion

Neither Qantas/GolfNow nor The Promoter accept responsibility for any tax implications, or amateur status that may arise from your participation in the Event or acceptance of any prize. Independent financial advice should be sought.

 

INDIVIDUAL EVENT

 

The 2019 Mission Hills Tournament will include an individual Stableford event held over 54 holes in conjunction with a 2 person - Four Ball Best Ball 54 hole event.

In the event of a tie for first place in either event the winner will be determined by reference to countback. The countback will be based on:

  • Best score over holes 10 to 18, if a tie continues;
  • Best score over holes 13 to 18; if a tie continues;
  • Best score over hole 16 to 18; if a tie continues;
  • Best score, hole by hole from 18 back to 1.

The decision of the Event Committee is final.
